1. Eligibility and approval
The program is intended for legitimate local businesses and organizations that serve customers in or near Yard Yay’s service area. Applicants must provide accurate information, be at least 18 years old and authorized to act for the applying business. Yard Yay may approve, decline, pause or remove a partner in its reasonable discretion.
2. Referral link and code
Approved partners receive a unique referral link or code. It may be used only by that approved partner and may not be sold, transferred, posted to coupon-code sites, used for spam or distributed through misleading advertising. Partners are responsible for keeping their account and referral information accurate.
3. Qualifying referrals
A qualifying referral must be an eligible new customer’s first Yard Yay booking and must be attributable to the partner’s unique link or code at the customer’s initial availability request. The eligible display subtotal must be at least $149. The $149 Single-Clown Celebration meets this display subtotal minimum.
For this program, the display subtotal includes the selected display package and eligible display upgrades before travel fees, taxes, gratuities or other non-display charges. The installation must be completed and payment received in full. Canceled, refunded, disputed, fraudulent, duplicate, test, self-referred, uncollectible or otherwise disqualified transactions do not earn a reward. Only one partner may receive credit for a booking, and referral credit is not applied retroactively.
4. Reward
Partners earn a flat $25 referral reward for each qualifying referral. The amount does not increase with the booking total. Rewards remain pending until Yard Yay verifies that the installation has been completed and payment has been received in full. Yard Yay will contact approved partners regarding the available payment method and processing timing. Partners are responsible for providing any payment or tax information legally required before payment and for their own tax obligations.
5. Required disclosure
Partners must clearly and conspicuously tell potential customers that they may receive a referral reward if the customer books through the partner’s link or code. A simple disclosure such as “I may receive a referral reward if you book through my link” is acceptable when presented with the recommendation.
6. Honest promotion and brand use
Partners must describe Yard Yay, its packages, prices, availability and service area accurately. Partners may use only current materials provided or approved by Yard Yay and may not claim to be an employee, agent, franchise, exclusive representative or authorized decision-maker. Partners may not register Yard Yay names, domains or social accounts; impersonate Yard Yay; make guarantees; or create advertising that is false, deceptive, offensive or unlawful.
7. No customer charges
Partners may not charge a customer to access the referral link, add a referral surcharge, collect payment for Yard Yay, sign agreements for customers or make a reservation on Yard Yay’s behalf.
8. Program changes and termination
Yard Yay may change the reward, eligibility rules or program procedures prospectively, or suspend or end the program. A partner may stop participating at any time. Fraud, spam, misleading promotion, brand misuse, customer complaints or violation of these Terms may result in immediate removal and forfeiture of unpaid rewards connected to the violation.
9. Independent relationship
Participation does not create an employment, agency, franchise, joint venture or exclusive relationship. Partners are independent businesses responsible for their own operations, statements, expenses, licenses, insurance and legal compliance.
10. Records and disputes
Yard Yay’s booking and referral records control whether a referral qualifies and whether a reward was previously issued, subject to correction of demonstrated errors. Questions should be raised promptly by emailing hello@yardyay.com.
11. Acceptance
By submitting an application and participating after approval, the partner agrees to these Terms, the Website Terms and Privacy Policy. Florida law governs these Terms to the extent permitted by law.
