1. Acceptance of these Terms
By accessing or using this website, you agree to these Website Terms and our Privacy Policy. If you do not agree, do not use the website. You must be at least 18 years old and able to enter a binding agreement to book a rental.
2. Website information and availability requests
Website descriptions, photos, prices, service-area estimates, and availability information are provided for general planning. Display details may vary based on inventory and site conditions. A submitted Request Availability form is only a request and does not create a reservation or require Yard Yay to provide service.
We review the requested date, address, inventory, travel distance, add-ons, taxes, and other details before sending a confirmed quote. Service-area maps and ZIP estimates are preliminary; the exact installation address determines the final travel fee and whether we can serve the location.
3. Reservations and rental agreement
A 50% reservation payment is required to secure the date and inventory after Yard Yay confirms availability and final pricing and the customer signs the applicable Rental Agreement. The remaining balance will be automatically charged to the card on file seven days before the celebration. Reservations made within seven days of the celebration require full payment at booking. If the final payment is declined, Yard Yay will notify the customer and provide 48 hours to complete payment. If payment is not received, the reservation may be canceled and the reservation payment forfeited.
The signed Rental Agreement and confirmed quote govern the actual rental, including cancellation, rescheduling, weather, installation, property access, equipment care, damage, removal, and photo permissions. If these Website Terms conflict with a signed Rental Agreement, the signed Rental Agreement controls for that booking.
4. Electronic communications and signatures
You consent to receive booking-related records and communications electronically at the contact information you provide. When you intentionally type your name, provide initials, select the required acknowledgments, and submit a signing page, you agree that action is your electronic signature. You should review and save or print the completed agreement for your records.
You are responsible for keeping a secure booking link private. Notify Yard Yay promptly if you believe a signing or payment link was used without authorization or contains incorrect booking information.
SMS Terms
If you separately opt in on the availability form, Yard Yay may send transactional text messages about your request, quote, reservation, payment, installation, and removal. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help, or contact us at 386-260-4YAY. SMS consent is optional and is not a condition of purchase. We will use email or customer care for essential information if you decline texts. See our Privacy Policy for how we handle your information.
5. Payments
Online payments are processed by Stripe and may be subject to Stripe’s terms and privacy practices. You authorize the amounts displayed at checkout. Do not submit payment unless the customer, event, package, date, and amount are correct. A declined, reversed, disputed, or incomplete payment does not reserve a date.
6. Acceptable use
You may use the website only for lawful personal or business interactions with Yard Yay. You may not:
- Submit false, misleading, fraudulent, or unauthorized requests.
- Attempt to access another customer’s booking or Yard Yay’s private systems.
- Interfere with the website, introduce malicious code, scrape it excessively, or bypass security controls.
- Copy, reproduce, sell, or commercially exploit website content, artwork, logos, mockups, or display designs without written permission.
- Use the website in a way that violates law or another person’s rights.
7. Intellectual property
The Yard Yay name, logos, website design, copy, graphics, package names, display images, characters, and other materials are owned by Yard Yay or used with permission and are protected by applicable intellectual-property laws. Limited personal viewing of the website does not transfer ownership or grant a commercial license.
8. Third-party services and links
The website may connect to third-party services such as Stripe, Resend, Twilio, mapping tools, or external links. Yard Yay does not control third-party websites or their independent terms, privacy practices, availability, or security. Use of those services may be subject to additional terms.
9. Website availability and disclaimers
We work to keep the website accurate and available, but it may occasionally be unavailable, delayed, or contain errors. To the extent permitted by law, the website is provided “as is” and “as available,” without a guarantee that access will be uninterrupted, error-free, or suitable for every purpose. Nothing in these Terms limits rights or warranties that cannot legally be limited.
10. Limitation of website-related liability
To the extent permitted by law, Yard Yay is not responsible for indirect, incidental, special, or consequential loss arising solely from use of or inability to use the website. This section does not limit obligations stated in a signed Rental Agreement, responsibility for our own negligence, or liability that cannot legally be limited.
11. Changes and termination
We may update the website and these Terms, suspend access, remove content, or discontinue features. The revised date appears at the top. Terms applicable to a completed rental agreement are preserved in that signed agreement rather than retroactively changed by a website update.
12. Governing law and severability
Florida law governs these Website Terms, without regard to conflict-of-law rules. Before filing a lawsuit about website use, the parties will first attempt in good faith to resolve the concern directly. If one provision is found unenforceable, the remaining provisions continue to apply.
